Court: “No systemic problem of disenfranchisement”

By way of Polinaut comes the order indicating which rejected absentee ballots should and should not be even considered. This is a major blow to Team Coleman who has fought to count illegally casted ballots and ballots by those not even registered to vote. The order also indicates that a large number of these rejected ballots were from voters who ultimately voted on election day or submitted another absentee ballot that was accepted. (And here I thought Team Coleman was against double counting.)

The Minnesota Independent breaks down the court order into which rejected absentee ballots would not be considered and which ones may still be considered. As much as Team Coleman wants to overturn the election results, it’s good to see that the courts are leaning towards making sure only legally cast votes are counted. Here’s two examples of types of ballots the court may still consider:

Returned by a nonregistered voter in an absentee ballot return envelope on which no box in the proof of residence portion of the envelope is checked by the witness.

Cast by a nonregistered voter who was not registered to vote in the precinct encompassing the voter’s address on the absentee ballot return envelope and absentee ballot application.

It is my strong guess that most of these types of ballots listed will be found to be not legal ballots. Everyone wants every single legal ballot to be counted — that’s why we had a recount. But fighting for the counting rejected absentee ballots from non-registered voters where the witness doesn’t even fill in the proof of residence, for example, is like fighting to endanger the integrity of this election in my opinion. But, alas, those ballots will see their day in court just to quadruple-check.

  • The judges did a good job ferreting out the catagories which have some legal merit. Looking forward to next week.

  • This won’t be over until Norm gets a ruling from the US Supremes on whether his equal protect rights to the Senate seat were violated when the people threw him out of office. 5 dollars will get you 4 that the Supremes will agree with him.

  • I got another Franken e-letter today. LOL for the part (paraphrased): going on 3 years now of asking for contributions,…
I send what I can every month or so…for, let’s see, 3 years? The situation must have a funny analogy…

  • SCOTUS won’t touch this.

  • Get ‘er done.

We need an end to this. There was a result & a winner.
    Norm has a job.

  • “Norm has a job.”

    United States Senator from Minnesota.

  • Cman please take the word of the present head of the Republican Party… on Fox News no less… to Glen Beck…

    RNC Chairman Michael Steele
“You have absolutely no reason, none, to trust our word or our actions at this point.”
    RNC Chairman Michael Steele

Get with the program, Nahm’s history and everybody knows it.

  • It aint over til it’s over!

  • It ain’t over until the GOP doesn’t need Coleman to not be there.

  • “former Senator Coleman”
    that’s all she wrote

  • Norm is going through the diligence that any candidate would with a margin of less than one-thousandth of one percent.

I respect our judicial system, and am sure that the most appropriate possible winner will be confirmed given the law…… given the circumstances, that is all we can ask for.

Whether we send one New Yorker or the other New Yorker, I’m ready to move on as soon as the courts are.

You hope! The fat lady hasn’t sung yet.

  • DantheMan,

    “I’m ready to move on”

You mean youre going to stop obsessively commenting Republican talking points here at MN Publius morning, afternoons, evenings, nights, and weekends?

  • Nitro — I don’t think you would have much to talk about if DTM did stop commenting. From what I’ve seen, he adds a well thought out and informed message (even though you disagree with most everything he says). And without a few right leaning contributors here, you could not dazzle us with your profound insight.

  • “You mean youre going to stop obsessively commenting Republican talking points here”

You mean my moderate talking points? I’d say I align more with Jim Ramstad than I do John Kline. Either way, no. I think Zach and co. do a nice job here, and I enjoy frequenting the site. I guess when you are secure in your ideology, you have no problem going into hostile territory and discuss the issues of the day.

  • I love how the right wingers “respect the judicial system” and believe that republicans are “going through the diligence that any candidate would” when it could potentially benefit their backwards, destructive ideology, but spend the rest of their time complaining about “trial lawyers” and “our litigious society” when it’s not republicans reaping potential benefit from the court system.

And yes..it is “former senator Coleman”

    For now.

  • MOre thannlikely if the Mn Supreme Court rule that AL Franken is the nest Srnator from Minnesota, Norm should do the right thing and not file an appeal. Why drag this out even further. This has already gone to the highest Court in the state.

    Enough already!!!

  • Now that the obstructionist GOP’ers have lost and the stimulus bill will be signed by President Obama on Tuesday, Norm’s vacancy is no longer necessary. Watch this drama come to a swift and abrupt end as Norm’s money pipeline gets shut down.

  • Doubt it! I don’t see a quick resolution. Besides, we have a lot of obstructing to do.

  • According to Politico, Norm was in Washington this past week at a big fundraiser held by the National Republican Senatorial Committee, which will help him keep his legal challenges going and then on to the appeals process. When John Cornyn, who chairs the NRSC, was asked how long Norm should keep going, he was quoted as saying, “However long it takes…He realizes how important retaining this seat is to us.” Obstuction and more obstruction - that the Republican way.

  • Some comments really are aggressive and yet so under-justified.
First, here’s a link about what Republicans have been about regarding elections:

Style of communication is something everyone should look up to help understand each other. Wikipedia, Google is fine.
Another recent source says the types are: expert, romantic, warrior, and mastermind.
These described as the dominating communication style (most skilled at and prefer to use upon meeting people) with secondary styles resorted to, down to the style least skilled at and most exhausting.
Then, Wiki “thinking-fallacies” or “group think”… I’d like to see some nice people grow a little while they’re on my field of vision here. Would you do that for me so I can like you?

  • Did anyone see Senator Al with Tom Hauser this week? Actually, last week? I saw a rebroadcast this weekend.

Ack! Finger pointing Tom really badgered by asking the same question four times (he didn’t like Sen Al’s answer the first three times, apparently).

Talk about tension. Thank God Hauser didn’t moderate the Rochester debate. What Republican slant!

Meanwhile, no representation, yet. Can’t our State legislators clarify they want Richie to appoint/ issue a writ to fill the vacancy? We need SOMEONE in there (and the recount did show Senator Franken to have won the election…)

    HELLO! Representation! Want it now!
